Food and Beverage Donation Made Simple
Food banks and pantries need shelf stable product year round. We match your surplus with recipients that can receive it in volume.
Short dated and overproduced
Product approaching its best by date, overruns and slow movers that are still wholesome.
Packaging and label changes
Old packaging, promotional packs and non safety label issues that retail will not accept.
Rejected loads
Loads refused by a retailer for non safety reasons, redirected to a food bank instead of a landfill.
Tax benefits for food donations
Food donations qualify for the enhanced deduction under IRC Section 170(e)(3) for most business types, not just C corporations. That can make donation the lowest cost option for surplus food. See our tax deduction guide and confirm the details with your CPA.
Liability protection
The Bill Emerson Good Samaritan Food Donation Act protects businesses that donate apparently wholesome food in good faith to nonprofits. The Food Donation Improvement Act of 2022 extended those protections further.
What cannot be donated
Recalled food, product with undeclared allergens, damaged or contaminated product and anything unsafe goes to certified food destruction or organics recycling instead, through Wasteless Group.
Food Donation Questions
What food can be donated?
Wholesome, properly labeled food and beverages, including shelf stable, short dated and overproduced product, mislabeled product where the label error is not a safety issue, and packaging changes. Refrigerated and frozen product is possible with the right recipient and cold chain.
Can we donate food past its best by date?
In many cases yes, because best by and sell by dates are quality dates, not safety dates, for most shelf stable foods. Infant formula and some products are exceptions. Tell us the dates and we will confirm with the recipient.
Are we protected from liability?
The federal Bill Emerson Good Samaritan Food Donation Act protects donors who donate apparently wholesome food in good faith to nonprofit organizations, and the Food Donation Improvement Act of 2022 expanded those protections. Speak with your counsel about your specific situation.
What about recalled or allergen mislabeled food?
Recalled food and products with undeclared allergens cannot be donated. We handle those through certified food destruction with a Certificate of Destruction.
